Please take the time to read the Terms & Conditions of booking set out below prior to booking a tour with us. We strongly recommend that you read the entire information relating to your tour, thus ensuring that you understand the itinerary, style and physical demands of the tour you are interested in.
The contract is between you (The Client) and Montravel Ltd (The Company) – a licensed Tour Operator in Bulgaria. On booking a tour with The Company, The Client agrees with the Booking Terms & Conditions (which constitute the entire agreement between the two parties) and the booking is accepted on this basis. In case one Client is making a group booking, all group members automatically accept and agree with the Booking Terms & Conditions. The services which are to be provided are the ones cited in the booking confirmation invoice.
Dates and itineraries are valid as described in the summary of the tour. After that the dates and itineraries are indicative only.
3. Deposit requirement
The Client is required to pay a non-refundable deposit (see paragraph 7) which is 50% from the total price of the tour per person and only in this case the booking is confirmed. For tours which cost 50 euro per person or less,100% of the payment is required. If the booking is made within 10 days of the departure date, then the full amount is payable at the time of booking.
4. Acceptance of booking and final payments
On accepting the booking The Company will issue a confirmation invoice. A contract will exist between The Client and The Company from the date The Company issue the confirmation invoice or The Company register the payment. The Client may refer to the booking confirmation invoice for details regarding final payments. Payment of the balance of the tour price is due 10 days before the departure date. If the balance is not paid before the due date, The Company reserve the right to cancel the booking.
5. Prices & surcharges
The tour prices are as cited in the offer but might be subject to changeable or seasonal pricing, both of which are normal practice in the travel industry. This means The Company’s tour prices may vary in accordance with demand, market conditions, promotions and availability.
6. The Client’s details
The Client’s details are required in order for us to confirm the reservation. The details may vary by tour. They might include full names by passport, date of birth, nationality, passport number, passport issue and expiry dates, medical insurance, etc.
The Company is also registered in the Register of Personal Data as administrator of personal data.
7. Cancellation by The Client
If the cancellation is made by The Client, some cancellation fees will apply. The cancellation will be considered effective when received in written. If The Client cancels a tour:
– 30 days or more prior to departure date, 100% of the paid amount will be returned.
– 15 to 29 days prior to departure date, 50% of the paid amount will be returned.
– 14 days or less prior to departure, no refund.
If The Client fails to join a tour, joins it after departure, or leaves it prior to its completion, no refund will be made.
8. Cancellation by The Company
The Company may cancel a tour at any time prior to departure if, due to Force Major (terrorism, natural disasters, political instability or other external events) it is not viable for The Company to operate the planned itinerary. If The Company happens to cancel the tour, The Client can transfer amounts paid to an alternate date or receive a full refund. In circumstances where the cancellation is due to external events outside the reasonable control of The Company, refunds will be less any unrecoverable costs. The Company is not responsible for any incidental expenses that The Client may have incurred as a result of The Client’s booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights
9. Booking amendments
Although The Company is very flexible and always tries to fulfill The Clients’ wishes, sometimes this opportunity is very limited or excluded. The Company contracts in some circumstances other companies, agencies, government institutions, local municipalities, etc. like hotels, transport companies, restaurants, lift/ski operators; therefore amendments in the booking are not always possible. All details should be clarified by the time The Client receive per email a Booking Confirmation. On a later stage any Amendments, made by The Client, could be not guaranteed by The Company.
Everything, included into the price of the tour(s) is specified on the website below the relevant tour(s). By the time The Client receives a written Confirmation of the booking from The Company, there should be information what exactly is included into the price of the tour(s).
On most of our tours, The Company has given optional extras like for example – visit of geothermal baths; museums; churches etc., which are not part of the deal however could be paid on spot by The Client in order to add extra value to the holiday. All options are not included and must be paid extra by The Client. As a general rule and unless otherwise stated, lift tickets (where applicable) are also not included into the price and need to be paid by The Client. As this information varies, depending on Multiday or Daily Tours, promotions, special deals, etc. please refer to the description of the relevant tour. Below each of our tour descriptions is specified what is and is not included. By the time The Client receives a written Confirmation of the booking from The Company, there should be information what exactly is included into the price of the tour(s). Anything, not mentioned in the confirmation should be treated as extra and not included into the regular price of the tour(s)
12. Age & Health requirements
Some of our tours are not suitable for children. Most of the tours, offered by The Company have no upper age limit though tours can be physically demanding and The Client must ensure that he/ she is fit to allow full participation. Clients under the age of 18 must be accompanied by a legal guardian who will be responsible for The Client under the age of days care. People with physical disabilities, walking difficulties, medical problems (like for ex. Asthma, Diabetes, etc) must share that information with The Company before booking the tour(s) as some tours are demanding, technically difficult, require good physical condition and not suitable for every person.
13. Small groups & combination trips
The tours, offered by The Company are guaranteed to depart when we have one fully paid Client unless minimum group size is required. This means at times we can have groups with small numbers of Clients. If The Client would like to know how many people are booked on specific, he/ she needs to inquire that information prior to booking. Some tours, offered on The Company’s website could also be combined: for example a hike could be combined with a visit of geothermal baths, which could add extra value to the holiday. Some extra costs and charges may apply therefore please consult our staff for more details.
14. Passport and visas
The Client is responsible to ensure that he/ she is in possession of the correct visas, permits and certificates for entering the country. The Company is not responsible if The Client is refused entry to the country because of the lack of the correct passport, visa or other travel documentation.
15. Travel insurance
Travel insurance is obligatory for all our Clients.The travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects.
The nature of this type of travel requires considerable flexibility and The Client should allow for alternatives. The itinerary provided for each tour is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
17. Change of itinerary
While The Company strives to operate all tours as described we reserve the right to change the tour itinerary.
If The Company happens to make a major change prior departure The Company will inform The Client as soon as possible if there is time before departure. When a major change is made The Client may choose between accepting the change, obtaining a refund of money paid or accepting an alternative tour offered.
The Company reserves the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by The Client. Please note The Company is not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
18. Authority on tour
The Company’s tours are run by a guide. The decision of the guide is final on all matters that might affect the safety or well-being of any Client. If The Client fails to comply with a decision made by a guide, or interfere with the well-being or mobility of the group, the guide may direct The Client to leave the tour immediately, with no right of refund. The Company may also elect not to carry The Client(s) on any future tours booked.
19. Acceptance of risk
The Client acknowledges that the nature of the tour(s) is adventurous and participation involves a degree of personal risk. The Client will be visiting places where the geographical attributes present dangers and physical challenges greater than those present in our daily lives. The Company use information like weather forecast; mountain rescue service; own contacts in assessing whether the itinerary should operate. However, it is also The Clients’ responsibility to acquaint themselves with all relevant travel information and the nature of the itinerary. The Client acknowledges that their decision to travel is made in light of consideration of this information and The Client accept that they are aware of the personal risks attendant upon such travel.
20. Limitation of liability
The Company contracts with a network of companies, government agencies and individuals to assist in the running of the tours as agent for these third parties.The Company is not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
– any liability for any loss, death, injury or damage which The Client may suffer (directly or indirectly) in connection with or arising out of his/ her participation in a tour, or any breach of the Booking Conditions, is excluded;
– The Client releases The Company and its officers, employees, agents and representatives from any liability and expressly waive any claims The Client may have against The Company arising out of or in connection with his/her participation in a tour; and
– any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.
To the extent an Implied Warranty cannot be excluded, The Company’s liability in respect of the Implied Warranty is limited to (in its absolute discretion): (i) the provision of a similar tour to an equivalent value; or (ii) a refund of the total amount received by The Company from The Client in connection with The Client’s booking.
Any claim by The Client is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.
21. Optional activities
Optional activities not included in the tour are not part of this contract. The Client agrees that any assistance given by the group leader or representative in arranging optional activities does not render us liable for them in any way.
22. Claims & complaints
In case The Client has a complaint about the tour he/ she must inform the group leader or The Company’s representative in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be sent in written to The Company.
23. Photos and marketing
The Client agrees that The Company use images of him/her, taken during the tour for advertising and promotional purposes in any medium we choose.The Client allows The Company to use such images for publicity and promotional purposes.
